Product Condition & Warranty Policy

LEV SHIPPING CONTAINERS sells containers in different conditions and configurations. The condition and specifications of each product are stated in its individual listing.

This policy applies to all products we sell, including shipping containers and trailers. All trailers we sell are new and are covered by the same 10-year limited structural warranty as new containers, from the delivery date, under the terms below. References to a “container” in this policy also apply to trailers.

1. New Containers

A product described as new will be supplied in the condition represented in its listing. Any specific description such as one-trip, manufacturer, model year or certification must be accurate and supported.

2. Used Containers

Used containers may show ordinary signs of prior use, including dents, scratches, surface rust, faded paint, repairs and cosmetic wear. The expected condition will be described in the product listing.

3. Wind and Water Tight (WWT)

WWT generally describes a container intended to prevent ordinary wind and water entry under the conditions associated with that grade. It is not a guarantee that a container is new, structurally perfect, cargo-worthy or suitable for every purpose.

4. Cargo Worthy (CW)

Cargo Worthy describes a container represented as meeting the relevant cargo-worthy criteria for its stated purpose. Any inspection, certification or transport eligibility must be verified for the particular unit and intended use.

5. Refrigerated Containers

Refrigerated container listings must identify the condition of the refrigeration unit and any testing or temperature-performance information available.

Customers should confirm the required temperature range, power supply, operating requirements and intended use before purchasing.

Unless explicitly stated in writing, do not assume that a used refrigerated container has a new refrigeration unit or a particular warranty.

6. Illustrative Images

Some website images may be representative images rather than photographs of the exact unit available for sale. Where this applies, the listing will disclose it.

Actual container color, markings, wear and other cosmetic details may vary. Material differences in condition or specifications will not be intentionally concealed.

7. Limited Structural Warranty

We want our customers to purchase with confidence. We offer the following limited structural warranty terms for eligible shipping containers, subject to the conditions, exclusions and claim procedures below.

7.1 Warranty period

• New shipping containers: 10-year limited structural warranty from the delivery date.
• Used shipping containers: 5-year limited structural warranty from the delivery date.

The applicable warranty period will be confirmed on the product listing, invoice or written warranty certificate. If a product has a different warranty, the specific written warranty provided with that product will apply.

7.2 What the warranty covers

Subject to inspection and the terms of this policy, the limited structural warranty covers qualifying defects in the container’s original structural components that materially affect its structural integrity or intended storage function. Coverage may include:

• Structural frame defects: qualifying failures in the original main frame, corner posts or structural rails caused by defective materials or workmanship.
• Structural weld failures: covered failures of original structural welds that materially compromise the container’s integrity.
• Roof or wall panel defects: qualifying material or workmanship defects in original panels that cause abnormal failure beyond ordinary wear and tear.
• Door and locking structure: qualifying defects in original door frames, hinges or locking-bar assemblies that result from covered manufacturing or structural defects.
• Covered water-entry defects: where the container was sold as Wind and Water Tight (WWT), qualifying defects in the original structure or seals that cause wind or water entry under ordinary conditions, provided the issue is not caused by damage, wear, misuse or an excluded event.

Coverage is limited to the components and defects identified in the applicable written warranty. A cosmetic issue alone does not qualify unless expressly covered.

7.3 What the warranty does not cover

Unless required by applicable law or expressly agreed in writing, this limited warranty does not cover:

• Normal wear and tear, cosmetic scratches, dents, fading, surface rust or paint deterioration.
• Corrosion caused by salt exposure, chemicals, standing water, poor drainage or lack of reasonable maintenance.
• Damage caused by accidents, impact, vandalism, fire, floods, storms or other external events.
• Damage caused by overloading, improper lifting, incorrect handling, stacking or transportation after delivery.
• Unauthorized cutting, welding, painting, structural alterations, door modifications or other modifications.
• Damage caused by improper foundations, uneven ground, inadequate support or unsuitable installation.
• Damage resulting from misuse, neglect, improper storage or failure to maintain the container.
• Refrigeration machinery, electrical systems, insulation, flooring or other specialized equipment unless expressly included in the product’s written warranty.
• Indirect losses, business interruption, lost revenue, removal costs or relocation costs unless expressly covered or required by law.

7.4 Special conditions for used containers

Used containers have a history of prior service and may show cosmetic wear, repairs, dents, patches, faded paint or surface rust. These conditions do not automatically constitute warranty defects when they are consistent with the condition disclosed at the time of sale. The 5-year warranty applies only to the structural components and defects specified in the written warranty for the particular unit.

7.5 How to make a warranty claim

To submit a claim, contact our customer service team at info@levshippingcontainers.us and provide:

1. Your order number or proof of purchase.
2. The container’s delivery date and identification details, if available.
3. A clear description of the issue.
4. Photographs or videos showing the defect.
5. Any relevant maintenance, inspection or repair records.

Please notify us promptly after discovering a potential covered defect. Do not carry out major repairs or modifications before receiving written instructions, unless immediate action is reasonably necessary to prevent injury or further damage.

7.6 Inspection and resolution

We will review the claim and may request additional photographs, documentation or an inspection by an appropriate service provider.

If a covered defect is confirmed, the remedy may include repair, replacement of the affected component, replacement of the container or another reasonable remedy permitted by the written warranty and applicable law. The specific remedy will depend on the nature of the defect, product availability, repair feasibility and the applicable legal requirements. No remedy will be promised until the claim has been assessed.

7.7 Warranty limitations

This is a limited warranty and applies only to the original purchaser unless a written warranty states otherwise.

The warranty does not replace routine inspection, maintenance or safe-use practices. It also does not guarantee that a container is suitable for every building, transportation, refrigeration or storage application.

Nothing in this policy excludes any statutory consumer right or warranty that cannot legally be excluded. Please retain your invoice and warranty documentation for the duration of the applicable warranty period.

8. Product Suitability

Customers are responsible for checking dimensions, weight, access, structural requirements, electrical requirements and local permits for their intended use.
